Terms of Service

App: Henry (“Service”). Operator: Angel Jaime, NYC, USA (“we”, “us”).

1. Acceptance

By creating an account or using Henry, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

You must be at least 18 years old to create an account.

2. What Henry is

Henry is a software tool for parents and caregivers to log events about a newborn (feeds, pumping, diapers, weigh-ins, vaccines), view trends, and compare against general age-appropriate benchmarks.

3. What Henry is NOT

Henry is not a medical device. Henry does not provide medical advice, a medical diagnosis, a treatment plan, or any form of professional care. Information in the app, including benchmarks and trends, is for your general awareness only. If you have any concern about your child's health, feeding, growth, or development, contact your pediatrician. In an emergency, call your local emergency number.

4. Your account

• You are responsible for activity on your account.
• By creating an account about a child, you confirm that you are the child's parent or legal guardian, or have informed parental/guardian consent. You are responsible for the accuracy of the data you log.
• You may invite co-caregivers (e.g. a partner, grandparent, nanny) to view and edit a baby profile. Invited caregivers have full read/write access to that baby's data. Only invite people you trust.
• You may remove a caregiver at any time in Settings.

5. Children under 13

The Service is intended for use by adults (18+) recording data about a child in their care. The Service is not directed at children under 13, and we do not knowingly allow children to create accounts. See the Privacy Policy for our handling of information about a child whose parent or caregiver records data with Henry.

6. Acceptable use

You agree not to:

• Use the Service for anyone other than a child under your care, or with the informed consent of that child's parent or legal guardian.
• Attempt to access data belonging to another user.
• Reverse-engineer, scrape, or bulk-export data in a way that bypasses the Service's normal interfaces.
• Use the Service to violate any law or the rights of others.

7. Your data, your control

You own the data you put into Henry. We take a limited license to process it for the purpose of running the Service, as described in the Privacy Policy.

You can export your data to CSV and delete your account from Settings at any time.

8. Pricing

Henry is free. We do not run ads. We do not charge for any feature, and we do not have a paid tier.

Henry may offer optional voluntary donations via Apple's in-app purchase system (a “tip jar”). Donations are not required and do not unlock additional features. The Service remains free regardless. Donations are processed by Apple under Apple's terms.

If we ever introduce a paid feature, existing features and data access will remain free. We will notify you at least 30 days before any pricing change that might affect you.

9. Intellectual property

• You own your data. Anything you log in Henry — your baby's profile, events, notes — is yours. We claim no ownership.
• We own Henry. The Henry name, logo, app interface, illustrations, and code are ours. We grant you a limited, non-transferable, revocable license to use the app for your own personal, non-commercial purposes.

10. Service availability

We aim for high availability but do not guarantee uninterrupted or error-free Service. We may introduce planned maintenance with reasonable notice.

11. Changes to the Service

We may add, modify, or remove features over time. If we make a material change that reduces your ability to access your data, we will give you at least 14 days' notice and a path to export.

If Henry is shut down, we will give you at least 30 days' notice and a full exportable archive of your data.

12. Termination

You can stop using Henry at any time by deleting your account.

We may suspend or terminate an account if:

• (a) we reasonably believe it is being used to spam, harass, defraud, or harm others;
• (b) the data being logged appears clearly fabricated or used for purposes outside individual baby tracking;
• (c) we are required by law.

13. Disclaimer of warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim related to the Service is limited to USD $50 or the amount you paid us in the 12 months before the claim, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

This limitation does not apply to liability that cannot be excluded under applicable law (e.g. gross negligence, fraud, or statutory rights you may have as a consumer).

15. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or your misuse of the Service.

16. Governing law and venue

These Terms are governed by the laws of the State of New York, USA, without regard to its conflicts-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York County, New York, except that either party may seek injunctive relief in any court of competent jurisdiction. We do not require arbitration.

If you are a consumer in the EU/UK, mandatory consumer-protection laws of your country of residence still apply.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.

18. Assignment

We may assign these Terms to a successor (e.g. an entity that acquires Henry). You may not assign your rights under these Terms.

19. Notices

We will give you notices by email to your account email, or by in-app banner. You may send us legal notices to hello@henrytheapp.com.

20. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. They supersede any prior agreement on the same subject.

21. Changes to these Terms

If we make material changes we will update the “Last updated” date and notify you in-app at least 14 days before the change takes effect.
